CramSession.com, (CramSession) offers the use of this Web Site and Content on the condition that you accept and agree to the Terms and Conditions of Use contained in this Agreement.
CramSession operates a free website, and a Free Membership is an option in order to access certain areas of the site and to obtain other benefits. The Membership process requires you to submit information including an email address. If you provide CramSession with an email address for purposes of Membership, you certify that the email address is accurate and belongs to you. CramSession may share your name and email address with its trusted partners for the purpose of providing you offers which may be of interest. Please see our Privacy Policy for more information.
By becoming a Member of CramSession, you agree that CramSession may, from time to time, send you email that we believe may be of interest to you. If you do not wish to receive any communication from CramSession, you must cancel your membership and stop using any and all of the beneficial Member Services available.

ONLINE COMMERCIAL TRANSACTIONS
CramSession maintains a web site, EncryptedCart.com, for the purpose of processing credit card transactions for the CramSession web site and on behalf of its advertisers, partners or affiliates who wish to take advantage of this service. CONDUCT
You agree to use CramSession for lawful purposes only. You may not use, or allow others to use your CramSession membership to:
Post or transmit any content that is abusive, vulgar, obscene, hateful, fraudulent, unlawful, threatening, harassing, or defamatory;
Post or transmit any material that you do not have a right to transmit under law (such as copyright) or under contractual or fiduciary relationships (as in nondisclosure agreements);
Violate the rights of privacy and publicity of others;
Post, transmit, or link to sexually explicit material;
Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity;
Post or transmit statements that are intentionally false or misleading;
Post or transmit chain letters or pyramid schemes;

Intentionally violate any applicable law.
CramSession may at any time, and at its sole discretion, terminate your membership without prior notice, for violation of the above provisions. You are responsible for all statements made and acts that occur through the use of your membership.
While we can not review every transmissions by members or visitors to the web site, nor do we have an obligation to do so, we do reserve the right to, and may from time to time, monitor any information transmitted or received through our service. CramSession, at its sole discretion and without further notice to you, may review, edit, remove, or otherwise block any information (including posts to message boards) that we deem inappropriate or that violates any of this Agreement. You agree that the CramSession web site contains public communications that will be read by others without your knowledge and that others may be aware of your IP address or your CramSession login information. You acknowledge that CramSession does not endorse or control any of the content in its public forums. CramSession forum hosts and managers may act in the interests of enforcing this Agreement and other CramSession policies, but are not authorized spokespersons for CramSession. Forum hosts and managers alone are responsible for their views, which are not necessarily those of CramSession.
BRAIN-DUMP AND WAREZ POLICY
"Brain-dump" is defined as the practice of copying and sharing actual certification exam questions and/or answers for any purpose whatsoever. Brain-dumps are unethical and violate the policies and copyrights of certification exam providers. Brain-dumps also represent a violation of exam non-disclosure agreements. You agree that you will not provide brain-dumps, ask for information about the location of brain-dump sites, or provide any information intended to guide people to brain-dump sites.
"Warez" is a slang term used to described illegal or unauthorized copies of commercial, licensed software (also known as bootleg software). You agree that you will not ask for or provide information on the location of 'warez' software or various cracks that are intended to circumvent the software protections vendors have implement to protect unauthorized use of their software.
DISCLAIMER OF WARRANTIES AND LIABILITY
CramSession does not warrant the completeness or accuracy of the news, information, or entertainment content found in its web site, nor does it warrant its usefulness for any particular purpose. Further, CramSession shall not be liable to anyone for any loss or injury resulting from the direct or indirect use of its web site content, services or products, or third-party web site content, services or products. This includes, but is not limited to, loss or injury caused in whole or in part by our negligence or by contingencies beyond our control in creating or delivering any portion of the service. CramSession shall not be liable for any decision made or action taken by you or others based upon reliance on news, information, testing or any material published by CramSession. All information provided on CramSession is to be used on an "as is, with all faults" basis. CramSession relies on various sources of information that we believe to be accurate and reliable. If any provision in this Agreement is invalid or unenforceable, the remaining provisions will continue in full force and effect. This Agreement shall be governed by the laws of the United States of America and the State of Florida (except with respect to choice of law), as if the Agreement was a contract wholly entered into and wholly performed within Florida. You agree that the proper forum for any claim arising under this Agreement shall be the State of Florida, County of Hillsborough.
